El\u00a0Govern\u00a0de la Generalitat va anunciar recentment l&#8217;aprovaci\u00f3 d&#8217;un Decret llei destinat a ampliar la contenci\u00f3 dels preus dels arrendaments temporals i residencials una mesura, que es realitza a l&#8217;empara de la Llei Estatal pel Dret a l&#8217;Habitatge.<\/p><h2><strong>Qu\u00e8 implica aquesta nova regulaci\u00f3?<\/strong><\/h2><p>Amb aquesta nova regulaci\u00f3 s&#8217;expandeix el control sobre els preus dels lloguers, posant especial focus en els arrendaments temporals amb la finalitat d&#8217;evitar la pr\u00e0ctica d&#8217;alguns arrendadors de declarar com a temporals contractes que, en la pr\u00e0ctica, s\u00f3n permanents en una estrat\u00e8gia que els permetia evadir el l\u00edmit de preu m\u00e0xim establert per l&#8217;\u00edndex de refer\u00e8ncia.<br \/>Amb la implementaci\u00f3 d&#8217;aquest Decret llei, es busca bandejar aquesta pr\u00e0ctica i aix\u00ed s&#8217;equiparan els denominats lloguers temporals com els conclosos per motius laborals, educatius o m\u00e8dics, amb els lloguers destinats a satisfer les necessitats d&#8217;habitatge permanent.<\/p><h2><strong>Distinci\u00f3 entre lloguer de temporada i permanent<\/strong><\/h2><p>Conforme al nou Decret llei, els arrendaments amb prop\u00f2sits temporals que cobreixin necessitats d&#8217;habitatge permanent estaran subjectes a les mateixes limitacions que els lloguers de llarga durada. D&#8217;altra banda, els lloguers recreatius i vacacionals no es veuran afectats, per ser arrendaments de temporada quedant fora de l&#8217;\u00e0mbit d&#8217;aplicaci\u00f3 de la norma.<br \/>Aix\u00ed doncs, per a evitar possibles conflictes legals i assegurar el compliment de les regulacions vigents ser\u00e0 essencial que els arrendadors especifiquin en el contracte clarament el dest\u00ed i \u00fas que l&#8217;arrendatari donar\u00e0 a l&#8217;habitatge arrendat.<\/p><h2><strong>Regulaci\u00f3 de lloguers d&#8217;habitacions<\/strong><\/h2><p>L&#8217;abast d&#8217;aquesta nova llei no es limita \u00fanicament als lloguers d&#8217;habitatges complets, sin\u00f3 que tamb\u00e9 abasta els lloguers d&#8217;habitacions. En aquest sentit, els arrendadors han d&#8217;assegurar-se que el cost total de totes les habitacions no superi el l\u00edmit establert per a l&#8217;habitatge en el seu conjunt. Aquesta disposici\u00f3 busca evitar que s&#8217;eludeixin les regulacions en desglossar el lloguer en unitats m\u00e9s petites.<br \/>Per exemple, en un pis amb tres habitacions el cost total de les quals \u00e9s de 900 euros mensuals segons l&#8217;\u00edndex de refer\u00e8ncia, el preu m\u00e0xim per a cada habitaci\u00f3 individualment seria de 300 euros, mantenint aix\u00ed el l\u00edmit establert per la llei.<\/p><h2><br \/><strong>Aplicaci\u00f3 de l&#8217;\u00edndex de preus<\/strong><\/h2><p><br \/>L&#8217;\u00cdndex de Preus, implementat el mar\u00e7 passat, \u00e9s una eina fonamental en l&#8217;aplicaci\u00f3 d&#8217;aquestes regulacions. S&#8217;aplica en zones declarades com\u00a0tensionadas, enteses com aquelles on els preus de lloguer han experimentat un augment sostingut en els \u00faltims anys. Aquest \u00edndex serveix com a refer\u00e8ncia per a determinar la quantia dels nous contractes d&#8217;arrendament i ser\u00e0 d&#8217;obligat compliment quan l&#8217;habitatge pertanyi a un propietari que tingui la consideraci\u00f3 de \u201cgran forquilla\u201d o quan l&#8217;habitatge no hagu\u00e9s estat llogada en els cinc anys precedents.<br \/>En la signatura de nous contractes, l&#8217;aplicaci\u00f3 del rang alt o sota de l&#8217;\u00edndex dependr\u00e0 de la negociaci\u00f3 entre inquil\u00ed i propietari, per\u00f2 mai podr\u00e0 superar el preu de l&#8217;\u00faltim contracte si l&#8217;habitatge ha estat llogada en els \u00faltims cinc anys.<\/p><p><br \/>L&#8217;ampliaci\u00f3 de la regulaci\u00f3 dels lloguers a Catalunya representa un pas significatiu a considerar i \u00e9s fonamental que tant propietaris com inquilins estiguin al corrent d&#8217;aquestes noves disposicions i compleixin amb les seves obligacions legals per a evitar possibles conflictes en el futur.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>En el panorama legal de Catalunya, s&#8217;ha gestat un canvi significatiu en la regulaci\u00f3 dels lloguers d&#8217;habitatge, amb implicacions importants tant per a arrendadors com arrendataris.
